Falsy, civil servant with the Regional Development Planning Body in Jayapura, (Badan Perencanaan Pembangunan Daerah, Bappeda) Amnesty International is concerned for the safety of Don Falsy who has been in detention since 29 September 1998 and who has been denied access to his lawyers, raising fears that he is at risk of ill-treatment.Don Falsy was arrested without a warrant at his home in Jayapura, the capital of the province of Irian Jaya, by local police and taken to Polres (Police Resort) Jayapura, where he continues to be detained. The day after his arrest, his wife was allowed to visit him but two lawyers, who were given power of attorney by Don Falsy's family, were refused access.Amnesty International believes that Don Falsy's arrest is in connection with his alleged role in planning a meeting in Jayapura to discuss the independence of West Papua, as the province is known to local people. Press reports state that a person referred to only as ''DF'' is currently under interrogation for his alleged role in planning a meeting to establish a ''Committee for the Independence of West Papua''.It is believed that Don Falsy has been charged under Article 110 of the Indonesian Criminal Code which covers acts of rebellion and attempts to separate part of the state.Amnesty International believes that Don Falsy is a possible prisoner of conscience who appears to have been detained for the peaceful exercise of his beliefs.BACKGROUND INFORMATIONThere has been opposition to Indonesian rule within Irian Jaya, both armed and peaceful, since de facto authority over the province was transferred from the Netherlands to Indonesia in 1963 and a subsequent plebiscite in 1969, which resulted in a vote for integration. In recent days, the Indonesian Armed Forces have announced that they have agreed a cease-fire with the Organisasi Papua Merdeka (OPM), Free Papua Movement, the most prominent group advocating independence.In the months since the resignation of former President Suharto, in May 1998, there appeared to be greater space for the expression of political opinions in the province and as a result public demands that Irian Jaya's status be re-visited were growing. Don Falsy's arrest is in contrast to what had been interpreted as greater signs of political openness in the province.RECOMMENDED ACTION: Please send telegrams/faxes/express/airmail letters in Bahasa Indonesia or English or your own language: - urging the authorities to allow Don Falsy immediate, regular and on-going access to his lawyers; - urging the authorities to ensure that he is not at risk of ill-treatment and that he is released from custody if he is being held solely for the peaceful expression of his beliefs in support of West Papuan independence; - reminding the government of Indonesia of its commitment to the Universal Declaration of Human Rights, in particular Article 19: "Everyone has the right to freedom of opinion and expression...''APPEALS TO:Please note that fax tones to Indonesia can be difficult to obtain.
